1. The service
Mabny is software for engineering and construction firms to track projects, stages, documents and payment milestones. Mabny is actively developed: we add, change and sometimes retire features, and some may be offered as previews or pilots.
2. Accounts and workspaces
- Each customer has its own workspace. Its administrators decide who is invited and what role they have.
- You must give accurate information and keep access to your email and Google account secure.
- You are responsible for activity in your account. Tell us promptly if you suspect unauthorised access.
- You must be at least 18 and able to enter into a binding agreement.
3. Plans, trials and fees
Mabny may be offered as a free trial or pilot and then as a paid subscription. Fees, seat limits and billing terms are set out in your order or agreement with us. If fees are not paid when due, we may suspend access after giving notice. Unless stated otherwise, fees are non-refundable.
4. Your content
You own the content you and your team put into Mabny. You give us permission to host, process and display it only as needed to provide and support the service. You are responsible for having the right to upload it, including any client or third-party information. How we handle personal data is described in our Privacy Policy.
5. Third-party services
Mabny works with services such as Google Sign-In and Google Drive. Your use of those services is governed by their own terms. Files stored in your Google Drive stay there, under your control. We are not responsible for third-party services or for changes to them that affect Mabny.
6. Acceptable use
You agree not to:
- break the law, or infringe anyone’s rights, through Mabny;
- try to access other organisations’ data, or probe, scan or overload our systems;
- reverse engineer the service, except where the law allows it;
- resell or share access outside your organisation without our written agreement;
- upload malware or content you have no right to share.
7. Your professional responsibility
Mabny helps you track work. It does not submit anything to authorities such as Dubai Municipality, DEWA or Civil Defence, and it does not give engineering, legal or financial advice. You remain responsible for your projects, submissions, approvals, deadlines and invoicing, and for checking that the information in Mabny is accurate.
8. Availability
We work to keep Mabny available and reliable, but we do not guarantee it will be uninterrupted or error-free. Planned maintenance and events outside our control may cause downtime.
9. Ending the agreement
You can stop using Mabny at any time. We may suspend or end access if you seriously or repeatedly breach these terms, or if the law requires it. When a workspace is closed, its administrators can request an export of its data within 30 days. After that we delete it as described in our Privacy Policy.
10. Disclaimers
Except as expressly stated in these terms, Mabny is provided “as is” and “as available”, without warranties of any kind, to the extent the law allows.
11. Limitation of liability
To the extent the law allows, Mabny is not liable for indirect or consequential losses, or for lost profits, revenue or data. Our total liability for any claim relating to the service is limited to the fees you paid us in the 12 months before the claim arose.
12. Changes to these terms
We may update these terms. If a change is significant, we will let customers know before it takes effect. If you keep using Mabny after that, you accept the updated terms.
13. Governing law
These terms are governed by the laws of the Emirate of Dubai and the federal laws of the United Arab Emirates. The courts of Dubai have exclusive jurisdiction over any dispute.
